Welcome to promptengineering.be! These terms of service ('terms') govern your use of our website and services, including the purchase of prompt packs. By accessing or using our services, you agree to be bound by these terms.
1. Account registration
To access certain features, such as purchasing prompt packs, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account.
2. Prompt packs and purchases
2.1 Product descriptions
We strive to provide accurate descriptions of our prompt packs. However, we do not warrant that descriptions are error-free. If a product offered is not as described, your sole remedy is to contact us for resolution.
2.2 Payment
All purchases are processed through Stripe. By making a purchase, you agree to Stripe's terms of service and privacy policy. Prices are listed in EUR and are subject to change without notice. You are responsible for any applicable taxes.
2.3 License to use prompts
Upon successful purchase of a prompt pack, you are granted a non-exclusive, worldwide, perpetual license to use the prompts for personal or commercial purposes. This license does not grant you the right to resell, redistribute, or sublicense the prompts themselves as standalone products or as part of a competing prompt marketplace. You may use the output generated by using the prompts for any purpose permitted by the AI model's terms of service.
2.4 Refunds
Due to the digital nature of our products, all sales are final. Refunds will be considered on a case-by-case basis for technical issues or misrepresentations. Please contact us within 7 days of purchase if you encounter any problems.
3. User conduct
You agree not to use our services for any unlawful purpose or in any way that could harm, disable, overburden, or impair our services. You agree not to attempt to gain unauthorized access to any part of our services or to any other user's account.
4. Intellectual property
All content on this website, including text, graphics, logos, and the compilation of prompts (excluding the individual prompts once purchased as per section 2.3), is the property of D4N SRL or its content suppliers and protected by Belgian and international copyright laws. 'promptengineering.be' and its logos are trademarks of D4N SRL.
5. Disclaimers and limitation of liability
5.1 Disclaimers
Our services and prompt packs are provided 'as is' and 'as available' without any warranties of any kind, express or implied. We do not guarantee that the prompts will meet your specific requirements or that their use will result in any particular outcome. The effectiveness of AI prompts can vary based on the AI model used, its configuration, and the specific input provided.
5.2 Limitation of liability
To the fullest extent permitted by law, D4N SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services or prompt packs; (b) any conduct or content of any third party on the services; (c) any content obtained from the services or prompt packs; or (d) unauthorized access, use, or alteration of your transmissions or content.
6. Indemnification
You agree to indemnify and hold harmless D4N SRL, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of our services or prompt packs, or your violation of these terms.
7. Governing law and dispute resolution
These terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles. Any disputes arising out of or relating to these terms or our services shall be resolved exclusively in the courts of Brussels, Belgium.
8. Changes to these terms
We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new terms on this page and updating the 'last updated' date. Your continued use of the services after any such changes constitutes your acceptance of the new terms.
